"Scalialicious!"
-- Eve Tushnet

"Frankfurter was born too soon for the Web, but I'm sure that, had it been possible, there would have been the equivalent of Ninomania for Frankfurter."
-- Mark Tushnet
(I agree, and commented here.)

Religious rhetoric, demonizing the opposition -- and that's a Democrat!

Freshman Sen. Ken Salazar, D-CO, who has Focus on the Family as a constituent but it is at odds with it over judicial nominations, has called it and founder James Dobson "the Antichrist," provoking wry amusement from friends in the press. For the record, the Senator regrets the remark.

    Judicial filibuster fight

Bob Dole writes in The NY Times:
I still hold out hope that the two Senate leaders will find a way to ensure that senators have the opportunity to fulfill their constitutional duty to offer "advice and consent" on the president's judicial nominees while protecting minority rights. Time has not yet run out.

But let's be honest: By creating a new threshold for the confirmation of judicial nominees, the Democratic minority has abandoned the tradition of mutual self-restraint that has long allowed the Senate to function as an institution.

Many thanks to those who keep checking this blog, and sorry for light posting. It's not that there's nothing to write about, it's that we're at the end-of-class rush, and the exam-writing period.

There are also conferences. I was at Georgia State this past weekend sharing my thoughts on "Why Goodridge isn't Loving," i.e., critiquing, largely on historical grounds, the "miscegenation analogy" as a basis for same-sex marriage.

A controversial Supreme Court endgame is coming up. I'm sure I'll blog about it when I should be grading my exams. Keep checking in, and thanks for your patience.
