"Scalialicious!"
-- Eve Tushnet

"Frankfurter was born too soon for the Web, but I'm sure that, had it been possible, there would have been the equivalent of Ninomania for Frankfurter."
-- Mark Tushnet
(I agree, and commented here.)

Luttig to Bush administration: take this! Padilla case will stay with DOD, rather than move to criminal justice system -- and the Supremes will jolly well get their whack at it if they want to!

Latest e-ad from the ABA: a China Law Deskbook. The ad copy begins: "China has developed, and continues to develop, a legal system from scratch in just over 20 years." Well, scratch harder and discover some human rights.

Congratulations to my colleague (at the Government School) Jeffrey Morrison on his new book, John Witherspoon and the Founding of the American Republic, just out from Notre Dame Press, and the subject of a front-of-the-section, largely positive review (only objection: too scholarly!) in The Weekly Standard, Nov. 28, 2005, p. 29.

    Ayotte oral argument

    A former student writes in:
My prediction is that the Court will send it back down to the lower court with an order to try and more narrowly tailor an injunction to allow exceptions for medical emergencies. Even Ginsburg, of all Justices, seemed perplexed as to why the whole law was struck down just for these rare (if ever) emergency cases.

I was pleased with Roberts, I think he will be very good.
